Louisiana Songwriter Files Lawsuit Over Famous Christmas Hit

With Christmas right around the corner, stores all across the nation are beginning to play Holiday tunes. Songwriter Andy Stone, from New Orleans,  has filed a lawsuit complaining that this famous Christmas song was written based on his song.

Andy Stone, also known as Vince Vance, is once again trying to take down The Queen of Christmas. For the second year in a row, Vance has filed a lawsuit against Mariah Carey over the song "All I Want For Christmas Is You."

Andy Stone has his own band titled Vince Vance and the Valliants, and Vance is upset and filing a lawsuit because he feels that Carey ripped off the band's song “All I Want for Christmas is You" in 1989, which the band had written a few years before Carey's 1994 release. That’s no small claim: Carey’s “All I Want” has reached No. 1 on the Billboard Hot 100 during each of the past four holiday seasons.

Per USA Today, Vance's band "performed his hit songs in over 8,000 concerts across more than twenty countries" and claimed three of their 30 albums "attained Number One status on various charts" including their "number one Christmas song" released in 1989.

But the new case includes far more detailed allegations against Carey, including stating that she made up the story of how she wrote the song, and that her own co-writer has disputed that story.

“Carey has without licensing, palmed off these works with her incredulous origin story, as if those works were her own,” Vance’s new lawyers wrote in the re-filed complaint. “Her hubris knows no bounds, even her co-credited songwriter doesn’t believe the story she has spun. This is simply a case of actionable infringement.”
